products that are dangerous if used as intended by the
manufacturer, or defective products that made it onto the store
shelves. Factors to consider include how the product was
marketed (what did the sellers claim the product could do?), the
packaging of the product, instructions or warning about the use
of the product, and the reasonably expected use (and misuse) of
the product.
Medical
Malpractice and Nursing Home Liability
Reasonableness is also a factor
in medial malpractice and nursing home cases. Both doctors and
nursing home facilities owe their patients a reasonable standard
of care and can be held accountable to both victims and their
families if they do not live up to that standard. Because of the
nature of both professions, finding sufficient evidence to prove
a legal case can be challenging, so it is important to seek
legal advice as soon as you suspect a caregiver of not living up
to their responsibilities.
